1. This website address is for you to use as long as you adhere to the team and company policy guidelines.

2. After you have activated this form, you will be asked to set up your monthly payment subscription.  You may cancel your monthly payment subscription at any time.  

3.  Technical Support for your members area software is provided by Platinum Synergy Group Inc.  Marketing, enrollment and team assistance is not provided by Platinum Synergy Group.

4. Platinum Synergy Group reserves the right to shut down your account and take your website off line pending contact with you, the customer, to resolve an issue. This is a rare occurrence, and occurs in most instances when a website is used in violation of our anti-spam policy or the team policy that you agreed to when you became a member of that team.

5. By agreeing to these terms and conditions as stated above, you are bound to this policy and are legally responsibly for adhering to the rules and conditions stated. Any disputes against this policy, once you agree to the terms and conditions, are non-negotiable. If you have any questions or concerns about what you are agreeing to, please contact us before agreeing to the terms and conditions.

Affiliate Agreement

If you choose to upgrade your free members area account to the Affiliate Upgraded monthly subscription, you must adhere to the following policies to receive commission payments.

Qualifying Affiliates: To qualify as an Affiliate you must have an active and paid Home Office Pro service subscription.  Cancellation of this subscription, your Gano Tools account, or of your Home Office Pro services will terminate your qualification as an Affiliate.  Commission payments will stop being made on the date of service termination.

 

This agreement describes the entire terms and conditions which govern your participation in the Platinum Partners Affiliate Program, and the following definitions apply:

"Affiliate" and "Your" refers to you the “Gano Tools” applicant; "We" and "Our" refers to Platinum Synergy Group Inc., or its programs, including Home Office Pro and/or Response Magic. "Referring Web Site" refers to the Gano Tools web site from which Affiliate optionally links to the Platinum Partners web site; "Service" refers to an Platinum Partners service subscription, including Response Magic and/or Home Office Pro.

Referral Web Site: Affiliate may provide a link from a “Gano Tools” Referring Web Site to the Platinum Partners Web Site and earn commissions as outlined below. Affiliate may remove said link from a “Gano Tools” Referring Web Site and re-link to Platinum Partners at any time without prior approval. Affiliate will not display the Platinum Synergy Group Inc. or Platinum Partners name, image, or link in any way that may defame the Platinum Synergy Group Inc. (and its subsidiaries) name or brand.

Affiliate may not link to Platinum Partners from a “Gano Tools” Referring Web Site which promotes spam as described in this Agreement, sexually explicit material, violence, illegal activities, or discrimination based on race, sex, religion, national origin, physical disability, sexual orientation, or age.

Referral URL: Affiliate may advertise Platinum Partners using Affiliate's assigned URL (Universal Resource Locator) rather than, or in addition to, placing Platinum Partners' link on a “Gano Tools” Referring Web Site. Affiliate is solely responsible for ensuring that Affiliate's assigned URL is used in Affiliate's advertising, and Affiliate agrees that Platinum Partners cannot calculate commissions otherwise.

No Spamming: Promoting Platinum Partners via unsolicited email is strictly prohibited, and affiliate agrees to not reference Platinum Partners in any way, shape, or form, in any email that Affiliate sends in which the recipient has not specifically asked to receive it. In the case of mailings which are conducted by a third party on Affiliates behalf, Affiliate assumes full responsibility and is advised to perform due diligence to ensure that the mailing list is in fact 100% opt-in. Furthermore, Affiliate may not link to Platinum Partners from any URL that is promoted via unsolicited email. Finally, Affiliate may not advertise or reference Platinum Partners via USENET newsgroup postings in any way, shape, or form

Affiliate agrees that Platinum Partners will terminate this Agreement and withhold all commissions due if Affiliate is found in violation of this policy.

Adherence to Platinum Synergy Group Inc’s (or Platinum Partners Program) “Do not e-mail, E-mail Opt-Out system and/or Suppression List:  Affiliate agrees to not send email to anyone on Platinum Synergy Group Inc’s (including Response Magic, Home Office Pro, and all other subsidiaries) "do not email list" (aka "suppression list").  Contact us at support@platinumsynergy.com for customer support regarding the issue.  All e-mails MUST include an opt-out link at the bottom of the message, in according with CAN-SPAM legislation.  If a prospect requests to be removed off any mailing list by calling or e-mailing Platinum Synergy Group Inc., we must honour this request without notification or permission from the Affiliate who has this contact in their autoresponder system.

Qualifying Services: All Services sold by Platinum Synergy Group Inc. to customers originating from Affiliate's “Gano Tools” Referring Web Site or Referral URL -- and processed via Platinum Synergy Group Inc.’s payment gateways, online order forms, telephone or fax numbers, or mailing address -- qualify to earn Affiliate commissions as described below. Platinum Partners Program reserves the right to reject any order that does not comply with Platinum Partners Program policy.

Commission Amounts: Purchases of Qualifying Services by Affiliate's referred customers will earn Affiliate a commission according to the Tier 1 rates listed below. Should Affiliate choose to optionally introduce others to the Platinum Partners Affiliate Program, Affiliate will also earn additional commissions based on the purchase price of the Service paid by Affiliate's Sub-Affiliates'

Only Services for which Platinum Partners has received full payment qualify for commissions.

Definition of Sub-Affiliates: A Sub-Affiliate is defined as a third party that is in no way related to Affiliate, either personally or commercially. Affiliate is not permitted to register for the Platinum Partners Affiliate Program more than once, and any attempt to artificially inflate Affiliate's commissions will be grounds for immediate termination of this Agreement.

Affiliate understands that Platinum Partners monitors all Affiliate registrations and orders, and agrees that Platinum Partners will terminate this Agreement and withhold all commissions due if Affiliate is found in violation of this policy.

WHEN WILL I BE PAID?

Commission Payments: Platinum Partners will issue a commission payment in U.S. dollars for the applicable commissions either by PayPal or US Cheque, on or about the 15th of the a calendar month for the previous to last month's commissions if Affiliate is owed at least one hundred dollars ($100). An online statement of customer purchase activity is available to Affiliate at all times.  E.g. Commissions earned January 1st – 31st of a particular year will be issued March 15th.  This is to allow for our risk free trial, disputes, refunds and duplicate signups, etc. Commissions to be paid by cheque will not be issued without full name (or Business Name), mailing address and telephone number.  All Affiliates must ensure their contact information is complete and up to date.  A cheque will not be issued with incomplete information.  PayPal payments will be sent to the PayPal e-mail the Affiliate indicates in their contact information.  Platinum Synergy Group Inc. will not issue a PayPal payment to any Affiliate who does not provide this information.  Platinum Synergy Group Inc. will not split commissions to different individuals.  Only the Affiliate account owner will be eligible for the commission in his/her name personal, or business name.  If an affiliate has not accrued $100 by the end of the calendar year, they will be paid out any owed commissions on March 15th of the following year.  It is the Affiliate’s responsibility to affirm with their bank that they can accept a cheque based from Canada, drawn on a US funds.  Platinum Synergy Group Inc. will not be held responsible for an Affiliate’s inability to cash their cheque.  All cheques must be cashed within 120 days of issue.  Platinum Synergy Group Inc. will not re-issue cheques that are stale-dated.

Please note that commissions are paid 45 days after the previous “month” ending, not necessarily the date you accrue over $100.  If you reach the $100 threshold on April 5th for example, you will be paid your accrued amount on the “run date” for April, which is June 15th.  Payouts are done based on the entire reporting period, which is a calendar month.  You will earn your $100, plus whatever else was accrued for the rest of April (less refunds/chargebacks/cancellations) on June 15th.

Returns/Refunds, Chargebacks and Cancellations: If commissionable qualifying Services are returned or cancelled by Affiliate's customer, or Affiliate's Sub-Affiliates' customers, the corresponding commission(s) will be deducted as they occur, and deducted on the Affiliate's next monthly commission payment. Please note: Any virtual payments made by Visa or MasterCard are disputable by the card holder.  Each issuer or bank sets their own rules for the length of time available to commence disputes and charge backs.  Platinum Synergy Group Inc. has no jurisdiction over charge backs and cannot appeal a decision made by Visa or MasterCard regarding disputes.  Thus, any charge back will be logged for the founder and the chargeback commission amount will be deducted from the next available commission pay-out according to the established protocol.  Likewise, Platinum Synergy Group Inc will absorb its portion of any charge backs.  A $10 charge back fee will added to the original charge back amount and is the responsibility of the Affiliate, as this is the fee levied (in addition to the original charge) by our merchant for any charge back.

Platinum Partners Policy: Every customer who purchases a Qualifying Service is deemed to be a customer of Platinum Partners. Affiliate does not have the authority to make or accept any offer on behalf of Platinum Partners. Platinum Partners is not responsible for any representations made by Affiliate which contradict Platinum Partners policies, and Platinum Partners policies will always determine the purchase price of Qualifying Services.

Service Interruption and Tracking:  Platinum Synergy Group Inc. will make every effort to ensure that its web site is operational, and to track Affiliate's referred customers. However, certain unavoidable technical difficulties may occasionally cause temporary service and tracking interruptions. Affiliate agrees that Platinum Partners is not liable in any way for such interruptions.

References/Testimonials: Affiliate agrees to co-operate with Platinum Partners in the development of press releases, testimonies, and other such marketing materials. Affiliate grants Platinum Partners unlimited rights to reference Affiliate in any and all marketing materials, without further compensation.

Title: Title, ownership, and intellectual property rights in the Service shall remain with Platinum Partners Program and the Platinum Synergy Group Inc. The Service is protected by copyright laws and treaties. Title and related rights in the content accessed through the Service is the property of the content owner and may be protected by applicable law. This agreement gives you no rights to such content.

Copyrights: Affiliate is responsible for ensuring that Affiliate's advertising obeys all applicable copyright and trademark laws. Platinum Partners grants Affiliate the right to use Platinum Partners' name in acceptable marketing materials, but Platinum Partners is not responsible for Affiliate's misuse of any copyrighted material.

Limitation of Damages: Platinum Partners shall have no liability for any indirect, incidental or consequential damages, or any loss of revenue arising under or with respect to this agreement or the Platinum Partners Affiliate program, even if Platinum Partners has been advised of the possibility of such damages. Furthermore, Platinum Partners' aggregate liability arising under or with respect to this Agreement shall in no event exceed the total subscription fee paid by the customer.

Miscellaneous: Affiliate is an independent contractor, and nothing in this Agreement shall create any form of partnership, joint venture, franchise, agency, or employment relationship between the parties. Affiliate will not be treated as an employee with respect any Canadian or American employment law. Affiliate shall not assign this Agreement, by operation of law or otherwise, without the prior written consent of Platinum Partners. Subject to the foregoing, this Agreement is binding upon, insures to the benefit of, and is enforceable by the parties and their respective successors and assigns

Term and Termination: This Agreement will remain in effect for as long as Platinum Partners makes the Service available, unless the Agreement is terminated due to breach of its terms. Platinum Partners and Affiliate have the right to terminate this Agreement at any time by notifying the other party in writing. The final commission payment to Affiliate may be withheld for a reasonable time in order to ensure that the correct amount is paid to Affiliate.

Agreement Modification: Platinum Partners reserves the right to change any of these terms and conditions, at any time and at its sole discretion, by posting a new Agreement on the Platinum Partners web site and notifying Affiliate via email.

Governing Law: This Agreement shall be governed by the laws of the Province of Ontario, and country of Canada, and the parties agree that any claim, dispute or other difference shall be exclusively resolved by binding arbitration pursuant to the Crown Corporation or attorney General’s office of Ontario, Canada.
